In Pakistani real estate, the term "file" refers to the documentation package representing a booked or allocated plot in a housing scheme — before the physical plot has been developed or possession is available.

Understanding files is critical for investors in DHA, Bahria Town, LDA schemes, and private housing societies.


§📁 What Is a Property File?

A property file is a set of documents issued by a housing authority or society that:

  1. Confirms your booking of a specific plot category (e.g., 5 Marla, 10 Marla, 1 Kanal)
  2. Records your payment history
  3. Establishes your right to receive a specific plot upon balloting/allocation
  4. Can be bought and sold before physical possession is granted

Important: A file does NOT give you title to a specific piece of land until balloting and possession take place. It is essentially a future interest in property.


§📂 Types of Property Files

1. Booking File / Allocation File

  • Issued when you book a plot in a new or developing scheme
  • Contains: payment receipt, booking form, member number
  • The exact plot number is NOT yet assigned
  • Value increases as the scheme develops

2. Plot File (After Balloting)

  • Issued after balloting — your plot number is now assigned
  • Higher value than a booking file since the location is known
  • May or may not have physical possession depending on development phase

3. Open File / Transferable File

  • A file that is transferable — can be sold/bought in the open market
  • Most actively traded type in DHA and Bahria Town
  • Price fluctuates based on society progress and market conditions

4. Development File

  • Issued in schemes that are still undergoing development
  • Higher risk but potentially higher reward
  • Legal status depends on whether the society is LDA/RDA approved

5. Possession File

  • A file where physical possession has been awarded
  • The owner has the right to construct
  • Closest to a traditional property in terms of tangibility

Legal Considerations

A property file transaction is governed by:

  • Contract Act 1872 — the sale of a file is a contractual obligation
  • Transfer of Property Act 1882 — some courts treat file transfers as agreements for future transfer
  • The society's own bylaws — these are paramount for file transfers

Steps to Buy a File

  1. Verify the seller is the registered member in society records
  2. Obtain a fresh NOC from the society confirming the file is clear
  3. Check payment history — all installments must be up to date
  4. Execute a Transfer Deed / Sale Agreement
  5. Apply to the society for transfer of membership
  6. Society issues new documents in buyer's name (Transfer Letter, updated membership)
  7. Pay transfer charges to the society

⚠️ File transactions are NOT registered with the Sub-Registrar in most cases. They are internal society documents. This means your protection is contractual, not statutory. Always have a lawyer review the file documents.

Risk of Unregistered Files

  • No stamp duty or registration protects you
  • If the society collapses or is declared unauthorized, file holders have limited legal recourse
  • Always buy files in LDA/RDA/CDA-approved schemes only

Seller's Obligations

  1. Ensure all installments are paid up to date
  2. Ensure no transfer freeze is imposed by the society
  3. Obtain NOC for transfer from society office
  4. Sign transfer documents in society's presence
  5. Accompany buyer (or authorize via POA) to complete transfer at society office

Transfer Within Family

Most societies allow intra-family transfers at reduced charges. Eligible relatives typically:

  • CNIC copies of both parties
  • Relationship proof (NADRA Family Registration Certificate)
  • Existing file documents
  • Society application form

Transfer After Death (Inheritance)

If a file holder dies:

  1. Legal heirs must present Death Certificate to society
  2. Provide Succession Certificate or Heirship Certificate
  3. Society transfers file to legal heirs (usually proportionally)
  4. Heirs may then sell or retain the file
