Will (Wasiyat Nama)

A Will (Wasiyat Nama) is a legal document in which a person declares how their property and assets should be distributed after their death. In Pakistan, Islamic inheritance laws (governed by the Muslim Personal Law) apply, and a Will cannot override the fixed Quranic shares of legal heirs. However, up to one-third (1/3) of the estate can be bequeathed to non-heirs or for specific purposes.

§Important Note on Islamic Law

Under Pakistani law, a Muslim cannot will away more than 1/3 of their estate to non-heirs. The remaining 2/3 is distributed among legal heirs as per Quranic shares (Faraid). Always consult a qualified Islamic scholar or lawyer for complex estates.

§When You Need This

  • Distributing specific assets to chosen beneficiaries
  • Providing for a disabled family member
  • Donating to charity (up to 1/3)
  • Appointing a guardian for minor children
  • Avoiding family disputes after death

1. Declaration of Faith I declare my faith in Allah and His Messenger. I direct that my funeral rites be conducted in accordance with Islamic tradition.

2. Settlement of Debts Before any distribution of my estate, all my outstanding debts, loans, and liabilities shall be settled first.

3. Specific Bequests (up to 1/3 of estate) I hereby bequest the following from my estate:

  • To [Name, Relation]: [Description of asset / amount]
  • To [Charitable Organization]: PKR [Amount] for [purpose]

4. Residual Estate The remainder of my estate shall be distributed among my legal heirs according to Islamic Law (Faraid) as applicable.

5. Executor I appoint [Executor's Full Name], CNIC [CNIC], as the Executor of this Will. In case of his/her inability, [Alternate Executor] shall act.

6. Guardian for Minor Children I appoint [Guardian's Name], CNIC [CNIC], as guardian of my minor children [Names] until they attain majority.
